Terms of Service

These Terms of Service ("Terms") govern your access to and use of Jetnight, including the API, dashboard, website, and any related services (the "Service"). By creating an account or making an API request, you agree to these Terms.

"Jetnight", "we", "us" refers to the operator of the Service. "You" refers to any individual or entity using the Service.

1. Eligibility

• You must be at least 16 years old.
• You must have legal capacity to enter a binding contract.
• If acting on behalf of an organization, you represent that you have authority to bind it.

2. Accounts & API keys

• You are responsible for keeping your password and API keys confidential.
• Any action taken with your API key is deemed authorized by you.
• Notify us immediately at security@jet-night.com if a key is compromised.
• Per-plan key limits apply. Keys may be revoked, rotated, or rate-limited at any time for abuse or security reasons.

3. Plans, tokens & billing

Token bundles

• Plans grant a fixed token allowance (e.g. 1M, 5M, 20M) routed through our endpoint.
• Tokens are consumed at the rate set by each upstream model provider. We mirror their tokenization and pricing.
• Bundles do not expire while your account is active and in good standing.

Payment

• We accept SBP, Russian-issued cards, crypto (USDT, BTC, ETH), Cryptobot, and xRocket.
• API keys are delivered instantly once payment is confirmed by the processor.
• All prices are listed in rubles (₽). Crypto payments are converted at the rate displayed at checkout.

Refunds

• Unused token bundles are refundable within 7 days of purchase, minus a 10% processing fee, provided no more than 5% of the bundle has been consumed.
• Partially consumed bundles beyond 5% are non-refundable.
• Crypto transactions are refundable to the original wallet only; we are not liable for lost funds sent to wrong addresses.
• Refunds are processed to the original payment method within 10 business days.

4. Acceptable use

You agree not to:

• Use the Service to violate any law or third-party right.
• Generate, store, or distribute malware, phishing, or content that exploits minors.
• Resell, sublicense, or repackage the Service as a competing API gateway without written permission.
• Scrape, crawl, or otherwise extract data from our dashboard or infrastructure.
• Attempt to reverse-engineer, decompile, or circumvent any security or rate-limit mechanism.
• Share a single key across multiple unrelated end users (fair use applies; contact us for volume licensing).

5. API availability & SLA

• We target 99.9% monthly uptime for the API endpoint, excluding scheduled maintenance and upstream provider outages.
• Provider failover is automatic on Pro and Scale plans; Starter and Beam rely on the primary provider.
• We do not guarantee availability of any specific upstream model, which depends on its provider.
• Service credits are available for confirmed outages below the SLA — contact support with your request logs.

6. Intellectual property

• The Service, brand, and code remain our property. You receive a limited, revocable license to use the Service per these Terms.
• Content you send through the API remains yours. We claim no ownership of your inputs or outputs.
• Model outputs are subject to the terms of the applicable upstream provider; we pass through no IP warranty beyond their own.

7. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. Model outputs may be incorrect, biased, or unsafe. You are responsible for reviewing outputs before use.

8. Limitation of liability

• To the maximum extent permitted by law, our aggregate liability for any claim arising from the Service is limited to the amount you paid in the 3 months preceding the event.
• We are not liable for indirect, incidental, special, or consequential damages, including lost profits, data loss, or business interruption.
• We are not liable for outages or changes caused by upstream model providers.

9. Termination

• You may close your account at any time from the dashboard.
• We may suspend or terminate access for violation of these Terms, fraud, or security risk.
• On termination, unused tokens are forfeited except where a refund applies under Section 3.

10. Changes to these Terms

We may update these Terms periodically. Material changes (pricing, usage rights, liability) will be announced 14 days in advance by email and a dashboard banner. Continued use after the effective date binds you to the revised Terms.

11. Governing law

These Terms are governed by the laws of the Russian Federation, without regard to conflict-of-law principles. Disputes will be resolved in the courts of competent jurisdiction at our registered address, except where mandatory consumer law requires otherwise.
